A juvenile delinquent in New Hampshire is " a person who
has committed an offense before reaching the age of 17 years which
would be a felony or misdemeanor under the criminal code of this
state if committed by an adult and is expressly found to be in
need of counseling, supervision, treatment or rehabilitation as
a consequence therefore means ." NHRSA Title XII Chapter
169 B-2. There are no trials for juveniles, unless they are certified
to be tried as adults. Juveniles have the right to a trial in
front of a District Court Judge and the only right of appeal is
to the Supreme Court of New Hampshire. Juvenile Defenders are
paid via a flat fee contract, an hourly rate of $60, or by salary
if they are Public Defender employees.
Delinquency cases among the state's wealthiest youth were 3.9
times higher than CHINS, 4.7 times higher than CHINS in middle
income groups, and 5 times higher than CHINS children in the poorest
income category.
